Sunrise Lift Removal & Privatization: The publicly accessible Sunrise Lift has been removed, with discussions indicating it will be converted into a private lift. This effectively cuts off access to Cobabe Canyon for the general public.

No Pricing Caps & Exclusive Access: There are no restrictions on pricing, allowing access to be monetized at the owner's discretion. In Weber County, officials are justifying this shift by arguing that private lifts are still "available"—but only to those who purchase a home, reinforcing exclusivity.

No Commitments to Public Access: There are no formal commitments ensuring that any portion of the lift infrastructure or the underlying ski area will remain public. The absence of a formalized development agreement means future access remains uncertain and subject to further privatization.

Weber County Planning Documents
The original Development Agreement, signed on January 13, 2015, between Summit Mountain Holding Group, LLC and Weber County, along with its amendments (including the Second Amendment on November 1, 2022), establishes how Powder Mountain must be developed based on its 2014 Rezone Application and Master Plan.

Section 1.2: The commitments made by the Developer and the County in the Rezone Application and Development Agreement are legally binding and must remain in effect, even if the property changes ownership.

Section 1.4: The official Rezone Application is kept on record at the County offices, and any changes to the agreement must be made in writing.

Section 4.1: The Developer must develop the property according to the promises made in the Rezone Application and Master Plan.
Public Access and Benefits
The Rezone Application emphasized public access and community benefits, including:

Public Access: The Developer promised that all recreational amenities (such as ski and snowboard areas) would be open to the public. The approved Recreation Plan even details how specific areas served by Village and Mary’s Lifts would remain accessible. These areas are now private.

Public Benefits: The project was meant to provide more recreation, lodging, retail, and attractions that benefit the broader community. Instead, they have created private lodges and will be building a private spa.

Community Integration: The plan stated that the new development would blend with the surrounding Weber County communities and maintain public access to outdoor activities while minimizing disruption to existing neighborhoods.
